Allstate auto insurance claim question?
My car was leased recently seized. It was not very noticeable, but must still be determined. I took it to an appraiser / expert at Allstate and they gave me a check for 900 + dollars to pay zero. I still have to be repaired and I spent the money already. They sent me a notice saying if you do not get the car fixed, will prevent any fullfullment all future claims and I have to submit documents to the DMV about the vehicle scratched. My question is can I cancel my contract comes Allstate and get a different map w / o having to produce a book on scratch paper that has been fixed? Or would they somehow flag and tell me to cancel my plan? PS I could probably fix the scratch with wax or scratch Remover (really not too bad). Thank you
First, if the vehicle is leased, they should include the name of the lessor on the check, which would prevented you from cashing it. If they do not include the name of the lessor, the lessor would be able to file another claim with Allstate for the same loss and Allstate would have to pay ... again. Of course, Allstate would then attempt to recover your share of this amount second. Allstate can not refuse to honor your current contract / policy on future claims as these situations are unrelated. They actually said in a letter? If they did, it's a huge Mistater. My guess is that the expert screwed up big time by not putting the name on the check Leasor and now they are trying to strong arm you into having it repaired so they do not have to pay the same loss twice. But it could also mean that you may have committed insurance fraud by not using insurance money to repair your vehicle. It is a gray area I've never heard of it being strengthened anyway ... I know it could be strengthened or it applies. In any case, wait until your policy is not renewed.
