(Auto Insurance) Liability - Guy who hit me in charge of guilty to dangerous driving.?

When I lived in Red Deer, AB I have been involved in an accident, I was clearing an intersection on a yellow light. Since time was horrible that day it seemed that the driver who crosses the intersection did not stop, and T-boned the front end of my vehicle. We have both filed a police report and I already lost my car because I did not have collision on my insurance, my insurance rates also rose because I would have given to traffic coming the other way. It's been four months since the incident and I moved to Calgary. Just today, the RCMP phoned me and told me that I must appear before the court because the driver who hit me is responsible for dangerous driving. QUESTION: If he is accused, does that mean I am no longer responsible for the accident? Moreover, the AMA should lower my insurance rates than it was before the accident and not his insurance company have to replace my vehicle because he is guilty? I do not know the laws where your at. But if you had the right to go into the light yellow, then the accident is not your fault. In CA you are allowed to pass through a yellow light. So you see, if its legal where you are. I would call your insurance company and complain that the accident was not your fault, unless you know it is. You should make a claim with other liability insurance to get them to pay for your damages. Contact the Department of Insurance where you live or any government organization in charge of insurance companies.
